Auto Insurance Claims: clean title, delaware valley, penndot

Question
I bought a used car in '08, it has a clean title in PA, 2 wks ago a deer ran into my car, and it has been declared totaled. I paid full price for this car.   The adjuster is telling me it is only worth half because it is an "R" title, he got this information from Experian. I contacted the dealership I bought the car from, they were not aware it is considered an R title.  I have called Harrisburg (PennDot) and they recommended he go through PennDot to get that information.  He will not, says he already has the info he needs.  It was selvaged in 8-08 in Louisianna.  I don't know what to do. I have been paying full coverage on this car that is only worth $1,590?  What can I do. Who do I call.  I am waiting for the Title history and information from Harrisburg.  I contacted Camille Bud George's office.  They informed me to fill out a DL135 form.  I have done that.  If there is anything you can suggest, I would really appreciate it.  There should be something out there that protects the consumer.  I am the victim and I don't know where to turn, or who to get help from.  Thank you for you time and consideration.

Answer
Cindy,

The dealer had a duty to disclose the fact the vehicle had a reconstructed(R) title. Fortunately, you are protected by the laws in PA. The dealer had to have known the car had an R title, as it is right there on the document.

I suggest you contact a lawyer who specializes in consumer laws in PA. It should not cost you anything up front, as the attorney can collect his fees at settlement. If you want the names of one in the Delaware Valley (which is where I do business), you can e mail me directly at charlie@autoclaimshelp.net If not, do a web search or contact me.
