Auto Insurance Claims: who is a fault, ferraro, insurance company

Question
I lost control of my car when I hit a icy patch on the road and my car did a 180 turn. Another car hit me on the passenger side of the car and now his insurance company say I am at fault because I lost control of the car is this true? I feel for the road conditions the client was following to close and slide into my car not giving himself time to stop.

Answer
Ms. Humphrey,

Who is "at fault" is typically decided by a judge or jury.  The other insurance company is taking the position that it's your fault.  If you disagree with them then you're forced to sue them and try and plead your case.

I can see both your position and the other insurance company's position.  I can't predict how a judge or jury would find but I would expect that you would be found at least partially responsible for the accident.

Best of luck,

Ernest Ferraro
