Auto Insurance Claims: PD car fire caused by other vehicle, owners insurance company, origin and cause

My sons vehicle was parked at a public area.  The vehicle next to his caught fire.  The police and fire department where called.  On arrival they told my son he was not aloud to move his vehicle.  At this point there was no damage to his car.  The flames from the vehicle that caught fire past over to my sons vehicle and both vehicles were destroyed before the fire could be put out.  My son only carried liability and was not covered for comprehensive losses.  We placed a claim against the owners insurance company claiming property damage as a result of their vehicle's fire.  The insurance company has denied the loss due to no negligence on their part. We now want to appeal the decision what do we have to do?  And can you explain why they would not be liable?

Hi,

Technically, I would think they would be liable, but I am not a lawyer. It would be more interesting to know the type of vehicle that burned, the origin and cause of the fire etc. Let's say the burning vehicle was a Ford truck. You could possibly sue Ford if it was because of the defect that affects millions of them.
