Auto Insurance Claims: What about Passenger Rights, pg county maryland, uninsured motorist coverage

I was passenger in DC Taxi rear ended by at fault driver in PG County Maryland.  Taxi totaled.  Taxi driver and myself suffer PI. Taxi insurance Co is Bankers, they paid for the taxi, At fault driver has State Farm, I have Allstate/VA.  My medical bills +45K, BC BS will subrogate, my Lost Wages 15K, Transportation 5K.  My medical treatment is ongoing PT for a ruptured rotator cuff repair.  More than likely Policy Limits claim.  I am trying to educate myself on the process.  Please advise.  Also my UIM 50/100/50.  Can I get the 100K? or just the 50K.  Will Allstate cancel my policy because I file claim for UIM?  Is that legal? Hi Vanessa,

Your claim will be for the full policy limits of the at-fault drivers policy and then your uninsured motorist coverage. Neither will likely pay anything untill all of your treatment is completed.

How much you can get will be based on the wording of your uninsured motorist coverage. in some states UM coverage is in addition to the at-fault persons coverage, while in others it is inclusive of the at-fault persons coverage. You should call your company to see which you have.

Your insurance company can not cancel your policy for making a UM claim. Your limit of coverage under your UM is $50,000.00 for any one person. So you will only be able to get the $50k.
