Auto Insurance Claims: Car wreck I was in in January, chrysler town and country, toyota rav 4

Question
I was in a wreck in January.  Anyhow, I live in Illinois and turned left in front of someone because I didn't see them coming.  I got the ticket for failure to yield of cours.  I was wondering if my insurance company would put any of the blame on the other lady considering she didn't slam on her brakes to avoid the collision.  When someone pulls in front of me thats the first thing I do.  She is also trying to sue.  Will the fact that she didn't slam on the brakes end up effecting the outcome on the law suit and how much she gets out of my insurance company?  My car sustained $24,000 damage to it.  The speed limit in the area where the wreck happened was 45 mph.  Yes my car was totalled and so was their 2001 Chrysler Town and Country.  I had an 08 Toyota RAV 4.

Answer
Hi cari,

The fact that you turned left across oncomming traffic make this 100% your fault. The other car had the right of way. It does not matter thet she did not slam on her brakes.

This will likely not end up in court. Your insurance comapny will pay the damages up to the linmits of your policy. If you had minimal coverage and the other party is seeking more than the amount of insurance you have, your insurance comapny will notify you that and advise you to obtain an attorney to represent you for any amounts sought in excess of your policy limits.

I hope this helps
