Auto Insurance Claims: left turn accident, hi flor, incoming traffic

My family was involved in a left turn accident in which my husband was the driver. We we're at in intersection turning left. It was a 3 lanes street... First he make sure that it was safe to turn left, there was incoming traffic but they're light was on so the drivers from the 1st and 2nd make a gap so my husband can go thru and there was also a gap on the 3rd lane. All the drivers were stopped letting my husband go thru. So we were almost thru when the driver of the 3rd lane accelerated her vehicle and hit us on the left rear side. First she was stopped all the Sutton she accelerated her vehicle hitting us. The damages of my vehicle were right at tale left rear side and tale light.How much fault would my husband will be in titled?

Hi Flor,

Generally, when other car let you through and an accident occurs it is still your fault if the third car did not know you were comming out. But, in this case if the third car did see you and stop and then hit you it is their fault. Especially since they hit you in the rear corner of your car. You were mostly through the lane and the other car should have wiated.

In this case I would say that the other car is 75% at fault and your husband is 25% at fault. Unfortunately, this will only happen if the other driver tells the truth. If they say that they did not see your car until it was too late, the insurance company may find your husband to be 100% at fault. He will just have to make his best case and hope for the best.
