Auto Insurance Claims: After the Crash, crash my car, legal obligation

My car was involved in a hit and run while it was parked in my driveway.  The impact was so large that my car is not driveable right now.  THe back windshield is completely smashed in.  Because the back windshield has been smashed in the inside of the car has been exposed to the elements.  If some of the interior is further damaged while I wait on the insurance to come pick it up because of the smashed rear wind shield am I repsonsible for it.  I have cover it with trash bags but obviously it is not full sealed.

Hi Sean,
Since you state that the accident was a "hit and run", then you will be turning to your own insurance company to pay for repairs.  In order for your own company to pay for all the damage, less any applicable deductibles, you must be carrying full coverage including collision.
If you don't carry collision, but do carry comprehensive, then they will pay for the glass breakage, less your deductible.
You do have a legal obligation under the wording of the insurance policy to protect the damaged property against additional damage.
I suggest that you purchace some heavy duty plastic and a roll of duct tape from Home Depot or similar store and securely cover the rear window area.
