Auto Insurance Claims: rear ended, didnt get insurance, waste of my time, ok thanks

I was rear ended today while stopped in construction.  The other driver got out in traffic so I did too and looking at the back of my car everything looked fine, then traffic started and as I said it looks ok the guy said ok thanks and got back in his car.  When I stopped a few minutes later I realized there was damage on the side of my car that I didn't see from the back.  I didn't get any of the guys info (even plates).  Is there any hope for me?  Should I contact the police or is it a waste of my time?

From the information you have stated, unfortunately, I don't see any hope in this instance.
Even if you had gotten the guy's plate, he could have denied ever hitting you.
It's a difficult lesson to learn, but the next time anything like this ever happens, you will look more thoroughly at the damage, get all the information on the other driver and possibly call the police to report it. Documentation is everything.

You might want to call your insurance company and see if there is any way they might handle the claim if the damage is extensive. Granted, you may have to pay a deductible.

If there are only some scratches, they may buff out.
