Auto Insurance Claims: Car theft by minor, own insurance, comprehensive insurance

A friend of my son took my car and drove it, was chased by police and smashed it up as well as a wall and 2 other vehicles. They caught them and my son gave a statement and will appear in court later this month (although they seemed to think he would only pay a fine). I had only had the car 5 days and it was one year old.My son had given him the key.  They are both minors (aged 16) and not licenced, or insured.  Can I claim on our fully comprehensive insurance or should the boy's family pay?

Hi Denise,

This may become a very difficult and drawn out situation. The best this for you to do is to file the claim on your own insurance. Your insurance company will then pursue the other kid or his parents for reimbursement. That way you get your car repaired and you are removed from having to deal directly with the other people which could become very contentious.
