Auto Insurance Claims: rear end accident, car vehicle, rear end

Question
dear expert

i got into a accident on a 4 lane highway i (vehicle 1) was in the second left and the other car (vehicle 2) was on the second right lane the and he cut into my lane from a solid white line and slammed on his breaks and i couldn't do anything but to rear end him because when he cut into my lane there wasn't any space so can you please tell me who's at fault me (vehicle1)or him (vehicle2)

Answer
Hi Syed,

This would likely be considered 50%/50% liability. 50% on the other driver for unsafe change of lanes, and 50% on you for failure to control your vehicle. You are required to be able to control your vehicle regardless of what happens in front of you. However, there is a chance if you can convince the other side that simply had no time to react that you may get a lower percentage of fault.

I hope this helps
