Auto Insurance Claims: responsibility of driver to park within parking bay, illegal parking, pedestrian path

Question
i was driving down a narrow strip of road outside a parade of shops which has marked parking bays to one side and a pedestrian path on the other.  After the front of my vehicle passing the row of parked cars the rear side scrapped the back/bumper of the last one.  He was parked at an acute angle with the back of his car sticking out some distance outside the marked bay.  If he had been within the bay i would not have touched him.  I am not happy to take 100% responsibility for this incident and wonder what your thoughts are on this.  I have pictures of the way he was parked clearly showing him way outside the white lines of the parking space.  Any advice appreciated.  thanks

Answer
Hi Jayne-

I'm sorry to hear about your accident.  I'm also sorry to give you bad news.

I had an insured in my agency who went to pull out of her driveway and someone had parked & partially blocked the driveway.  My insured was found at fault.

Proper or illegal parking does not seem to be a factor when determining fault. From my experience, if you hit them you will be 100% at fault.
