Auto Insurance Claims: 1 car 2 accidents, accident 2, vehicle insurance

1 accident 2/15 opened claim, appraised but not settled prior to second accident 2/21. 2nd accident 2/21,opened claim, not appraised but Insurance company says combined damage totals vehicle.                             Insurance company wants to total my vehicle combine claims, charge me 2 deductibles,,,, or pay 1st claim at $9000 damage less deductible and then pay FMV less 1st payment and another deductible. What is legal here?

Hi Kermit,

What the insurance company is proposing is correct. The combination of the 2 claims totals the vehicle. If they pay the first claim but the repairs are not yet complete they would have to reduce the value of the vehicle by the amount of the needed repairs from the first accident.
