Auto Insurance Claims: Hit by driver not in cars insurance policy, letter in the mail, claim adjusters

Hello,

I was rear-ended back in January 23, 2007 and the driver of the other vehicle was found at fault. Pretty much cops came and gave him a ticket and he also had a suspended license. I got insurance information, contacted the insurance company that was given to the cops (infinity).

It has been a nightmare contacting this insurance's claim adjusters but I received a letter in the mail today stating that the driver who hit me was not part of the car owner's insurance plan. Their advice was going through my own insurance but the damage is not more than the deductible. What are my possible courses of action at this point that I might be out of luck with this insurance company?

Hi Luis,

As long as the driver did not live in the same household as the vehicle owner, then they will have to cover it. Most insurance policies require that all drivers in the household be listed on the policy. However, if the driver did not live with the policy holder your claim should be covered. You will just need to follow-up with the claims adjuster to find out.
