Auto Insurance Claims: NYS V&T law, legal question, clear path

Question
Can a driver who waves another driver on to make a left turn be held liable if the turning vehicle is subsequently hit? This is on a 4 lane, 2 lanes in each direction highway at an intersection.

Answer
Hi Ed,

Unfortunately your question is a legal question not an insurance claims question. In addition it would be speciific to the state that you are located in.

You should pose this question to an attorney who is licensed in the state where this happened.

This is a difficult questions since on one hand you could say that the driver is ultimately responsible for his own actions while on the other hand you could say that the person waiving the driver on holds some responsibility for making the driver think he had a clear path.

I hope this helps
