Auto Insurance Claims: Claims procedure, own insurance, true thanks

I was hit by someone running a red light and my vehicle is damaged. Their insurance agency tells me to take it up with their insured because they cannot file a claim without their permission.  I was just wondering if this is true.  Thanks.

Hi Dara,

The person you talked to is an idiot. This is the position that only a very few insurance comapnies take. They are just trying to force you to file the claim through your own insurance company so they don't have to do any work.

You should send a certified letter to the at-fault person directly telling them to contact their insurance company to report the accident within 3 days or you will file a lawsuit against them personally. You should also obtain a copy of any police report so you can provide it to the insurance company as proof that their insured was at fault.

If you can't wait for all of this to happen you may be better off to file the claim with your insurance. At least things will start moving and you can get your vehicle repaired.
