Auto Insurance Claims: liable, police the police, own insurance

Recently my vehicle was involved in a hit and run in the parking lot of a small store. A witness got her plate number then found the owner, me, and a police report was filed. This person was contacted by the police and was sited for leaving the scence of an accident. She gave insurance info to the police. The police gave us her info. When I contacted her she wanted to handle this without the insurance getting involved. Needless to say she is not handling it. The insurance will not cover it cause she was exempted from her husbands policy. Since she knew she was not covered was she in violation of the arkasas law requiring her to have liabily. Did she give false information to the police.

You essentially have 2 choices here;

1) You can file a claim with your own insurance and then they will try to get the money back including your deductible from the at fault person.

2) You can file a law suit against the at-fault person. However even if you win you still have to try to collect the money which may prove difficult.

You can try to send a certified letter to the at-fault person including a damage repair estimate, telling them that they have 5 days to contact you about payment or you will or you will seek other legal remedies.

That may get them to pay you out of pocket.
