Auto Insurance Claims: Prescription sunglasses, state insurance department, rayban sunglasses

My prescription RayBan sunglasses were damaged when I was rearended.The other driver was at fault.His insurance company is refusing to pay for replacement of my glasses,only repair.Repair was not an option because I need my glasses to drive and they would have had to be sent out for aprox. 14 days to repair them.The insurance company is telling me that, by Florida law, if something can be repaired, they do not have to pay for replacement.It seems to me that there would be some exception for an item that is needed on a daily basis to lead my normal life and for which there is no "loaner" available. Who is right?

I agree with you, as this seems logical. The alternative would have been for them to rent you glasses  while the originals were repaired but this would be unreasonable.  And I'm pretty sure they didn't suggest this to you.  I suggest you complain to the supervisor.  If this does not work, complain to the state insurance department.
