Auto Insurance Claims: Delay for payment for claim, formal complaint, ford explorer

I was rear ended on 12/04/07 while coming to a stop for a changing traffic signal. after placing a claim with the other drivers company 21st century, I was found not to be at fault. I was told by the adjuster that a check had been issued for the repair of my 2003 Ford explorer spot XLT on 12/13/07 I still have not received any payment. I followed up with the adjuster and she said she would cancel and resend. question is I feel like I am being lead on by the adjuster and should it take this long? what should i do?

Hi James-

I would give them the benifit of the doubt for now.  A check could have been stolen, especially if you mailbox is not locked and friends, neighbors, roomates etc. knew you were waiting for a check...  
They will probably have you sign an affidavit saying that you did not recieve the first check.
If you continue to have problems after that process is complete the next step is to make a formal complaint against the company. Search out the contact information for your department of Insurance and then let the adjuster know that if you do not recieve the check within a week you will be making a formal complaint against them.
