Auto Insurance Claims: Re:Procedures for auto theft claim, repair estimate, sole discretion

Hi,My car was stolen on oct23 and found on november 23rd.Is it on my discretion that i can refuse to take the car, since its after 30days or what is the rule.I don;t feel like driving that car since its vandalised.Its not a good feeling any more.What is the law in this regard.PLease let me know

Hi Direk,

Generally, an insurance company has 60 days to handle a theft claim. If the vehicle is recovered and your claim has not yet been paid, the insurance company will complete a repair estimate. If the cost to repair the vehicle is less than 75% of the vehicle's value the insurance company will likely opt to repair it. It is the insurance company's sole discretion whether to repair the vehicle or declare it to be a total loss. You can not abandon the vehicle to the insurance company.
