can i  put in two claims one with my insurance and one with the person responsible for the accident

Hi Evelyn,

No.  You can only collect from one or the other. If you collect from both that is insurance fraud.

The only exception is that if there are expenses that may not be covered by your own policy such as rental car or diminsihed value, but you are having your insurance company pay for the repairs, you can pursue the at-fault persons policy to get paid for the items you can not collect on your own policy.
