Auto Insurance Claims: Motorcycle deer accident liability, medical payments coverage, personal injury protection

My partner and I were involved in an accident when we hit a deer on a motorcycle.  I was injured; however, the insurance company is refusing to pay the claim as they stated the driver (my partner) was not "negligent".  Does liability insurance cover such an accident when there is nothing you can do to avoid the accident?

Liability insurance only covers damaged caused by the negligence of the insured party.  No negligence = no liability.  
This is why insurance companies offer additional coverages (for an additional premium) such as Medical Payments coverage for riders and passengers.  However, if this coverage was never purchased, then is certainly cannot be provided at this time.
This is not an insurance or "fine print" issue, it's common law in every state except where PIP, Personal Injury Protection, also known as No Fault Insurance is mandated.  Apparently, you were not in one of those states.
