Auto Insurance Claims: insurance claim, more than insurance, leinholder


Question
If the quote for repair is more than insurance will give , can the check be made out to the insuree instead of the place of business that quoted the work to be done.
Friends car got keyed, 6yr old vehicle, 1700 repair quoted..Insurance only giving 1000...Insuree cant afford the rest to get fixed , will need to find alternate paint person in order to afford

Hi Terry,

It sounds like this is being handled as a comprehensive claim of your friends own policy. Since they are claiming on their own policy, the claim is subject to their deductible. That means that the insurance company will pay the cost of repairs less the deductible.

In most states, if there is a leinholder on the vehicle, the insurance company is required to protect the interests of the leinholder. This is accomplished be either making the check payable to the policy holder and the repair facility or to the policy holder and the leinholder. This is done to preven the policy holder from taking the money and not repairing the vehicle.

If the actual cost of repairs is greater than what the insurance company pays plus the deductible, the body shop would simply submit a supplement to the insurance company and they would pay the body shop directly.
