Auto Insurance Claims: Salvage Title, salvage title, finance company


Question
In May of 2006, my car was hit while parked at my place of employment. Insurance information was exchanged and my claim was filed. I accepted the offer from their ins.Co.and opted to keep my car, but now I'm having so much trouble getting the salvage title from the DMV because of an error from the original finance company which did not sign off on the letter attached to my title that states that the lein has been paid in full. My question is: Can I now change my claim, is it now to late to think about suing the other party's insurance company?

You can try to call the finance company and ask them to provide a notorized letter indicating that the lein has been satisfied.

It is unlikely that the insurance company will reverse what has already been done. You made the deal that was accepted by all parties and they issued you a check and closed the file.  There would be no reason to sue the insurance company.

For the future, if a car is totlaed, it is always better to let the insurance company keep the car. Most people are not equipped to deal with title problems.
