Auto Insurance Claims: Whos insurnce company pays?, ford exploer, bodily injury liability

Ok, My girlfriend was driving my car for a day because hers was in the shop. She was stopped at a red light behind a Ford Explorer and a car rear ended her pushing her into the Ford Explorer. The driver who rear ended her has admitted fault and lucky the Ford Exploer driver was an off duty cop. Allstate the 3rd drivers insurance company has told us that they are resposible for the cars damages but not her personal injuries. So my question is when it comes to personal injuries whos insurance company is responsible? Her own insurance with Safeco? My insurnace which is Amex? Or is Allstate responsible? The accident took place in Kentucky which is a "no fault state" however my insurance is in Ohio where I live. Thank you for any help.

Hi Ron,

If the car was in Kentuckey at the time of the accident, then your policy should adjust to provide the required coverage in Kentucky. However you should contact your insurance company claims department to verify this.  If this is the case then your Personal Injury Protection (PIP) coverage would cover her injuries. If for some reason this is not the case, then she should make a claim on her own policy under her PIP coverage. If her medical bills exceed the amount of coverage under your or her PIP coverage, then she would make a claim against the at fault persons Bodily Injury Liability Coverage.
