Ok i have a question.  I just got a settlement offer from the insurance agent. They are stating that the injuries to my knee was from a previous accident. I did have knee injuries 2-3 years ago but nothing since than. So this accident reinjured my knee. So they ain't trying to pay my doctor bills dealing with this problem. Should i go ahead and counter offer or should i just go ahead and get a lawyer.

Hi Gary,

To the best of my knowledge, the statute of limitations in Virginia is 2 years for injury claims and 5 years for property damage claims.

You may want to check with a local attorney to be sure that I am correct.

Hi Gary,

Even though you may have had a previous injury, they still need to pay your medical bills and then some. If the insurance company is not dealing fairly, then you should seek the advice of an attorney. But hurry. If you are up against the statute of limitations, your time may be running out.
