Auto Insurance Claims: Responsibility?, parking lots, bea


Question
Is the lot owner responsible if my car is damanged when I pay to park in their lot?  I am in New York State.

Hi Bea,

In order for the lot to be responsible, they would have had to do something to cause the damage. Meaning that their attendant would have had to drive another vehicle into yours or something like that. Also most parking lots have signs up or a disclaimer on your parking stub that spicifically state that they are not responsible or any damage, theft or loss of personal items from the vehicle.

However, I am not an attorney and am not familiar with New York parking lot law.  If the damage is major, you may want to consult with an attorney near you to be sure.
