Auto Insurance Claims: Insurance replacing infant seat, personal injury insurance, soft tissue injuries

Question
On 5-6-06 my 6 month old and I were in an auto accident, 5 cars on a major highway in Oklahoma City, Oklahoma. I have searched online for information to see if it is required for the insurance company fixing our vehicle (Progressive) to replace my childs infant seat at their expense?

Answer
Dear Kelly,

The answer to your question is real simple.  The tortfeasor HAS TO REPLACE ALL DAMAGED PERSONAL PROPERTY with like or better.

For some good guidance on how to get top dollar for your damaged items, please scroll down on Car Accidents: Totaled, Repair, Valuation, Your Insurance Claim Rights http://www.settlementcentral.com/page0007.htm

That takes care of your question.  But the fact that your infant seat got broken raises a much more important question: what have you done to check for any possible internal injuries?  Probably nothing at all happened to your baby, but maybe the doctor could just check it out to be sure.

And what about you?  A crash that is hard enough to break an infant's seat impacted everyone in the car, including you.

I am a little worried that anyone with THAT MUCH PROPERTY DAMAGE inside the car likely sustained some pretty good trauma, and soft tissue injuries have a way of coming back to haunt you later when you start to get active in your first summer season since concluding your treatments.

I am also worried that the insurance adjuster will just offer a small sum "for your inconvenience and any aches and pains you might have."  DON’T TAKE THEIR MONEY TOO SOON.

By the way, did you know that getting an early settlement is a favorite trick of the insurance adjusters?  Please see my website wherein we show Insurance Claim Adjuster Secret Tactics http://www.settlementcentral.com/page0092.htm

Here is another page from my website that shows in detail why you should never make an early personal injury insurance claims settlement http://www.settlementcentral.com/page0211.htm

I know your car was hit with some pretty good momentum from the fact that the infant seat was broken.  And, of course, that trauma was passed along to your body, where it may have caused latent soft tissue damage.

I am worried for you that once you go through even half of your summertime outdoor activities, you will start noticing pains at night or the day following physical activity.

After a weekend of physical activity, you may notice a dull ache for the next three or four days.  That is a sign that you have residual soft tissue damage, and we need to account for that in making your valuation and in making your insurance claim demand letter.

Many people want to ignore that little nagging pain that comes after a full day at work or after doing spring yard work or other outdoor activities.  They do not realize that often times soft tissue injuries that are not resolved can be lit up again with physical activity.

And, of course, once you settle, that is it: no one will be there to pay for your future medical or chiropractic care; nor will you ever see another dime in pain and suffering money.

There may be a dull ache at night following some physical activity or pain the next morning.  DO NOT LET LITTLE PAINS GO UNATTENDED SINCE YOU DO NOT KNOW WHETHER THEY WILL CONTINUE OR GO AWAY.  We all hope and believe that such little pains will disappear soon.  But on the other hand, we have no way of knowing since this is the way serious soft tissue injuries can behave.

So, when this happens, even if a couple months or more post-treatment, do not hesitate to SEE A DOCTOR AND ATTRIBUTE THE PAIN TO THE ACCIDENT WITHOUT EQUIVOCATION.  It is NEVER TOO LATE TO REPORT PERSONAL INJURIES FROM A CAR ACCIDENT http://www.settlementcentral.com/page0104.htm
