Auto Insurance Claims: MY CAR IS A TOTAL LOSS, total loss auto


Question
A drunk driver crashed into my parked car, and now the insurance company is deeming it a total loss. I have a loan on the car, so b/c of this the insurance company is going to write the check directly to the loan company. Now I'm at a loss w/no car, and no money down for another car. How is this right? What can I do? Can I hire an attorney to take on my case? I'm not the one who crashed my car. Shouldn't they be responsible for making me whole again? I'm the victim here, and am getting screwed over.

It depends on the law in your ztate. They may have to include your name on the check. And if you fix the car, the money should go to you. Also, you may get to buy the salvage back. And read your sale contract with the leinholder to see what it says under "in case of loss or damage". You are also entitled to any "left over" money after the loan is paid off.
