Hyundai Repair: XG350 transmission noise, florida lemon law, 2004 hyundai xg350

Question
My 2004 Hyundai XG350 has a grinding noise at speeds around 20 MPH.  I have been to the dealer twice and was told this is normal with this transmission.  Today I met with the area factory rep and he test drove the car and said the same thing.  It cannot be fixed.  They have tried in the past to fix this problem without any success and no longer use this particular transmission.  He said there is nothing wrong and there should be no problem.  The noise is  only there at the low speed, high torque situation.  Do you agree or should I start a Florida Lemon Law claim.

Answer
Without hearing the noise, it's difficult for me to offer a useful opinion.  Your description of "grinding" causes me some concern, however.  I don't recall hearing any normal grinding noises coming from automatic transmissions.

Did the dealer or the factory rep identify the cause of the noise?  If so, what was the cause?

Whether you should start a lemon law claim is a matter of your personal preference.  Since the car is now approximately three years old, the lemon law may no longer apply.  If your considering a lemon law claim, you'll want to look into the provisions of the law to be sure it's worth your time and effort.

If all your interactions have been with one dealer, it may be a good idea to take the car to another dealer just to get their opinion.  Don't mention the visit to the first dealer.  If they, too, tell you the noise is normal, it probably is.  If they believe it to be abnormal, I expect they'll fix it.
