Yes, the driver's side tail light is brighter than the other. When the lights are off and I step on the brakes both lights illuminate but the driver's side is brighter. When the lights are on the driver's side is brighter again causing to stay on not making it noticeable when I press on my brake from the driver's side light. All other lamps are working fine.

If you mean one bulb is brighter than the other, then the bulb is probably shorted, incorrect, or incorrectly installed.  

Your question seems to imply that one and only one tail lamp stays on no matter what you do.  I cannot think of a rational explanation why this would occur.  If what I described above is not a correct interpretation of the situation, then I suppose I'd like to know the following:
1.  Do all the tail/parking lamps illuminate?
2.  Do the brake lamps all illuminate?
3.  When the lamp stays on, is it tail lamp brightness, or brake lamp brightness?
4.  Does this occur only when the tail lamps are turned on?
5.  Do any other lamps illuminate abnormally when this occurs?
6.  Anything else you can think to tell me that will help me understand the specific issue?

Okay.  Here's the most frequent problems:
1.  Incorrect bulb.  This can cause one side to be too dim or too bright.
2.  Poor or no ground in the passenger side socket or bulb.  This can cause a bulb to be too dim.
3.  Bulb incorrectly installed.  This can cause either an abnormally bright or an abnormally dim condition.
4.  Defective bulb.  The contacts inside the bulb may be touching.

I'd recommend starting by inspecting the bulbs to see if you can find anything abnormal.  If not, try two new bulbs to see if the problem goes away.
