Towing Issues: Giving your Vehicle Informtion to a Tow Company, antenna ball, pittsburg ca

Question
Richard,

I live in Pittsburg, CA and I was told by my HOA (Bay Area Property Services in Walnut Creek, CA) today the following:

Bay Area Property Services needs my vehicle information (make, model & lic. #) to give to BJ’s Tow located at 3235 E 18th St, Antioch, CA (925/757-3100).

I would like to know is it lawful for my HOA to give my vehicle information to BJ’s Tow company because the Guest Parking Guidelines has changed to NO homeowners are permitted to park in guest parking?

Please Help.

Answer
Well I hate to say it, but if you live in a HOA (Home Owner Association) development then the rules and regulations (called Convents there) are different and they can generally do what they want to.

If they say that only purple cars with a Jack in the Box antenna ball is allowed to park there, then they can do that...

Now as to the vehicle information, this sounds like they are going to start having the tow company "CRUISE THE AREA" looking for violations. That is somewhat legal in California and while a gray area for towing, think about what if your information is not on file...

You can be towed then, just like if you were parked in the middle of the roadway.

I think this is more for you, the tenant, renter, lessees' rights and protection than to just look for ways to make money or piss you off.

If you have real concerns then take them up with the HOA and see what the reasons are or what you can do to "stay private"
