Towing Issues: property in towed vehicle, illinois commerce commission, storage fees

My car was towed in illinois 2004 grand prix value 5 thousand dollars. never paid for tow or storage. court date by tow company was set after hearing tow company was awarded car. but tow company refuses to release paper work & tools in vehicle unless tow is paid! $175.00 dollars i dont have the money but want belongings back! DO THEY HAVE THE RIGHT TO KEEP MY BELONGINGS?

IN 99% of all cases the contents of the vehicle are held with the vehicle until towing and storage fees are paid. There are some exceptions on things, like bank records, medicine, things like that.

Now you did not mention who had it towed, a police department or it was towed from private property for illegal parking. That does change a few answers at times.

Now Illinois has a agency which regulates some towing and they might be able to help with the laws and regulations. Check out the Illinois Commerce Commission.

They will help a lot, and I hate to say it, but they do have that right to keep the property, like I said earlier in 99% of the cases.
