Towing Issues: tow, aaa card, small claims court

my son was towed to impound when he went to pick up his car he was told he had to pay for his car to be towed in advance for it be towed back to my house. big $. he paid cash in full. when I got home he explained.. I called the tow company, Told them that they can keep the car on the lot until monday %26 I will pay the fees for the storage %26 take a refund. . DO NOT TOW THE CAR HOME... he told me the car was still on. The kid on the phone hung up on me said he cannot get in touch with anyone. I spoke with the police dept %26 AAA. They both said he should not touch that car. About an hour later the driver showed up with the car %26 said he was never told not to deliver the car. I made him take it back. I went to talk to the owner. on Monday to explain the ordeal. he would not face me %26 told me to eat the Bill. I want to take him to court %26 report him to  BBB.

well I have little information on what is going on here as you did not mention the city or state in which this happened. Each city and state have different rules and regulations regarding towing.

And then you say the vehicle was impounded, but you do not say why. And that can matter also in answers. Reason is, lets say that the vehicle was not licensed with a current license and registration.
That is reason for many cities to have vehicles impounded, as unlicensed tends to mean not insured and that is a risk to the motoring public and against state laws.
Now towing an unlicensed vehicle back home, however stupid that sounds is generally legal. And since you mentioned AAA, did you know that they do not provide service for "UNLICENSED VEHICLES"
 So your AAA card would generally not be used.

Now, as to showing up and turning the tow truck back around, since the vehicle was already paid for and delivered, you incurred further costs by sending it back. More towing miles, standby time, and storage fees.

Now as to court, you can always go to Small Claims court, and you will need to provide lots of evidence and proof that you and your son were wronged and taken advantage of.

And for your information, the BBB (better business bureau) really has no way to force the tow company to do anything other than the threat of listing a bad report about them. They have "NO TEETH".

Just like the online "Ripoff report" site, lots of venting but no real action done.
