Towing Issues: towing, tow operator, road hazards

A tow truck recently dropped by car and he claims it was my vehicle that was defective. Since it was in his possession the entire time, is he liable regardless of the condition of my vehicle?

I need more information to properly answer the question but generally vehicles just don't drop off the tow truck. Was the vehicle in a wreck with damaged suspension components? As for your vehicle being defective, I am curious. Give more information with the situation.

As for the second part of your question my answer is not always but let me explain. Since I don't the whole story I'll refer to tire blow outs. Most times the tow operator is not responsible for tire or rim damage on wheel lift towed vehicles. The reason being is the operator has no control over the condition of the tire or possible road hazards. On the other hand, if the tire had obvious signs of damage, under inflation, or any other visual indication that could question the ability of the tire before the tow then the operator could be responsible for negligence.
