QUESTION: a friend of mine was driving a car with expired plates and she seen a cop coming so she pulled into a driveway of a friend pulled the keys from ingnition and got out of car, well the cop pulled in anyway and had car towed can they have a car towed from private property

ANSWER: If the state you live in provides for Law Enforcement to tow a vehicle for expired plates then yes, they definitely can. It probably did not help that she pulled into a driveway and someone took the keys because that just makes it look like someone is trying to get out of something to the police officer.

If your friend was arrested for Possession of Marijuana then the vehicle should have been impounded because that is a criminal offense. An officer does not have to initiate his lights and siren to make a vehicle stop. Both state and federal law and decisions of the US Supreme court allow an officer to conduct interviews without detaining someone unless they develop probable cause, then they can detain to investigate.
