Towing Issues: Towing in my apt complex, tow yard, leasing office

I live in an apartment in Memphis, TN and the leasing office has a contract with a tow company. Can the tow company tow my car if it is double parked in the parking lot in front of my building but is still running? There are signs posted saying you cannot park on the grass but not any signs about parking issues in the parking lot. We ran outside before he started lifting the car but the guy continued to lift the car even though it was still running. Is this legal?

From what you described there, I have to ask a few questions...


Was the vehicle parked in a "LEGAL PARKING SPACE"?

Was the vehicle parked in a "FIRE LANE"?

Was the vehicle parked in the "ROADWAY - DRIVEWAY" ?

You mentioned double parked, so that tells me that it was not parked in a proper space, and then it is subject to towing.
Signs or not, they do not have to list "EVERY POSSIBLE VIOLATION" which can cause a vehicle to be towed, or there would be 49383903030 signs in parking lots, because then every space would also need a sign or signs in it.

Now as to you catching the tow truck, well that is good I guess, as you generally have to only pay a drop fee instead of the full towing and storage fees at the tow yard.

What you described does sound legal to me.
