Towing Issues: My bank towed my car, small claims court, kansas city mo

Hi live in a Condo in Downtown Kansas City, MO.  On the bottom floor of my condo is my Bank that I do business at(M & I Bank)  They have a small parking lot with about 10 slots.  Each slot has a sign that reads (M & I Bank Customer parking only.  Unauthorized vehicles will be towed at your expense).  I am a customer of this bank & my car was towed Monday morning.  The bank is not open on weekends so a lot people try to park there with out getting towed.  The problem is I left my car there on Sunday & then on Monday once M & I Bank open they had my car towed at 8am.  I am a customer of this bank & have a Checking & Savings account their.  Do you think I can take this to small claims court & win.  I would like them to pay for my towing fee of $150 and $50 for court cost.  Also when I signed up for a checking & savings account the manager said I can park in the slots anytime because im a customer.  I had my car in their slot for 1 hour during their business hours & I got my car towed..  Thanks

Well if the bank has that small of a parking lot then you were "depriving a current customer" of a parking space. That is how the bank will look at it.

Now I am not sure if you have a parking space assigned for your parking from the condo, but if the only spaces for the condos are the banks then there will be a problem.

Remember that the bank most likely pays for the spaces in terms of rent or lease and they can do what they want to keep them. If they say that vehicles will be towed at any time then they can do it. Business hours or not, it depends on the "ownership of the parking spaces" as defined in the lease or what ever they have.

Being a bank customer has nothing to do with being able to park there, as you stated they only have 10 spaces, and I bet they have more than 10 customers who live in the condos or real close. If they all parked there and did not move by the time the bank opened then where would the bank customers and employees park???

As to suing the bank in small claims court, yes you can do that, but I would warn you to "not pee in your own pool"
The bank might just cut out all the parking rights and you would be out of luck then, or they can decide to make it hard for you to be a customer or what ever they want. Remember you do use them as your bank.

Hope this helps a bit but I might just chalk this up to learning and start watching the times real close if you are going to park there again.
