Towing Issues: Towing, customer issue, day at the mall

I imagine this was legal but still some states vary in laws. My car was towed from Pearlridge mall, this was the third time I have left my car overnight in the parking lot. There are signs saying for customers only which I am and have receipts from that day to prove it, but nowhere do the signs say no overnight parking, it does not specify a time limit and in some states they cannot legally tow your car without proper notice. I have time on my hands and I want to do something to them because I know it is a racket they have going on just for profit. Is there anything I can do???

Well you are right, each state has different laws and regulations regarding towing vehicles from parking lots... Since you did not tell me where you are at, I can not point you to specific laws and regulations...

But in your question, you raise the "customer issue" along with the "overnight issue"

If I read this right, you "were" a customer during the day at the mall, and that would be great for that time frame, but since you say that it was towed for parking "overnight" which I take and most laws would read as "NONE BUSINESS HOURS of the mall" it would mean to me and others, that at 11pm when the mall is closed and there are "NO CUSTOMERS" inside that it would be hard to claim you were a customer.

Since you "time on your hands" and you think it was and is a "racket" to have vehicles towed, I suggest that you do some research on the laws of your state (remember you did not read my instructions to give me that information so I can provide a more specific answer) and read all the laws regarding parking on private property, trespassing on private property, state parking regulations for vehicles, abandoned vehicle definitions and regulations to start with...
Each of those will affect what can be done and what is legal on both the property owners rights and your rights.

As to what can you do?

Well the courts are an option for you, and you can always take the tow company and the mall management - security to small claims court and try to get any of your money back, but remember you have to present the evidence as if it was a real court cause and prove to the judge that you were wronged and deserve to get repaid.

But that takes evidence, including proof that you did not break any laws, that there were no signs anywhere at all (most places have them at the entrances to the malls) which state the parking regulations, proof that it is either posted or not with signs (think pictures), proof that warnings or notices were either issued or not issued, and so on...

Time is what you say you have, and it will take time to get the evidence and it will take time to go to court and argue the case... You many win or lose, I can not tell you that answer, but its up to you to decide if it is worth it.
