Towing Issues: What to do?, rear brakes, tow driver

I live in Illinois. I had my 1996 Audi towed because the rear brakes were squealing and I didn't want to drive it to the shop that way. The tow driver asked what was wrong and I told him. Because he had a regular tow winch and not a flatbed, I asked if he needed me to back the car out of its parking space so he could hook it up from the front wheels. He told me no and that he had to hook it up from the rear. About an hour after I watched my car being driven away (to get my rear brakes replaced), my mechanic called and told me that the transmission was shot and that he knew as soon as he saw the tow truck with the car hooked up the way it was that he was going to have a problem. He got into the car and started the car and put it in gear, and the car would not move. The tow company rep told me more than once that my car had rear wheel drive and I told him repeatedly that my car had fwd. I'm trying to get them to take care of my car without having to sue, but what are my options here?

Contact the Audi Dealer about your model of vehicle and have documentation from them stating that damage would occur if towed in that manner. Once you have undisputed proof from Audi that damage will occur contact the tow company again and give them the chance to make it right. If not then file suit.
