Towing Issues: damage caused by tow co. while towing a semi truck, abs light, claims case

Hey, I just recently ran into this towing issue that I'm not so sure about. My husband is a truck driver and his truck was towed away from an area he used to always park in. His truck is an air ride and his brakes and wheels were locked when the motor is off. so what happened is that when we went to pick up our truck from the tow lot the brakes smelled like brake smoke and the ABS light was on and wouldn't go off. Now, my question is who should be responsible for these damages? We tried talking to the owner and he just wouldn't listen all he kept telling us is that we weren't allowed to park there which was not what we were disputing, the damages was what we were upset about. I am and always was under the  impression that once a towing co. tows your vehicle they are responsible to safely take your viechle to their yard without damaging it. Our truck shows all the signs of being force dragged.

If the truck was towed incorrectly then yes the tow company is liable. You would need to file either an insurance claim or a small claims case. Proof would be a good thing. Talk to your insurance agent to see what help they have to offer.
