Towing Issues: Towing from Private Property in Brighton, MA, consumer protection act, small claims court

I was towed from an alleged private drive (which looked like a street) next to a liquor store parking lot in Brighton, MA. The parking lot had towing warning signs on the front of the building but there were no such signs where I parked. Because I did not want to get towed I made sure I did not park in that parking lot. There was a foot high median dividing the parking lot and the unlabeled "private way." There were also three other cars parked in the area where I parked my vehicle. I couldn't find any information on the requirements of towing signs in MA. I noticed another person who posted mentioned a similar issue stating that it seemed unfair under consumer protection act. I would not have parked if I knew it was private property or there was a chance I would have been towed. The manager of the towing company insists that I take this to small claims court if I have an issue. I am certainly considering that remedy because I feel like I am being taken advantage of ... Do I have a decent case?

Now I have concerns about driveways and towing from them and its personal thoughts...
But its hard to properly mark a driveway which goes to one or more parking areas. After all who "really owns" the driveway is the big issue I see at times.

Now as to small claims court, that is always an option and the best advise I have for you is to have great documentation and as such collect as much paperwork, and pictures which show the issue. You have to convince the judge that you were wronged and that you did not break the law - regulations which they say you did.
