Towing Issues: towed on my own driveway, small claims court, tow company

Question
I have been towed from my own driveway. The tow company said they had instruction from the HOA. (this was 4 month ago). now I am a director of the HOA and do not find proof of such an instruction (verbally or none verbally). Prepaid lawyer says I need to proof that I was parked right. Can any towing company just come and "steel" my pickup and I have to proof that I was parked right (on my own drive way???)

Answer
Sieg,

A tow company must be authorized in one way or another to tow a vehicle off of private property. The person who used to be in your position would have had to have given some sort of instruction to the tow company. Other wise, your only recourse would be in small claims court
