Towing Issues: Fleeing a tow truck?, volvo station wagon, tow truck driver

Hey my name is Kevin from Newark, DE. I awoke to the sound of a tow truck backing up to my car in my parking lot.  I rushed downstairs to find that the driver had just lowered the bar behind my rear wheels, and was about to lock it into place.  I told him that I wasn't going to pay him and that I was going to drive away (although my car is a '92 Volvo station wagon, I was prepared to hop the curb).  He said that he would get me arrested if I did that, and advised me to pay the lesser fine for him to unhook and leave.  Is this an arrestable offense if he did call the police?  Fleeing from a tow truck? Reckless driving maybe for hopping the curb? But what proof would he have?

Well it does vary with some issues and to say that it is legal or not well that is hard to really say...

But there have been cases where people drove vehicles off of tow trucks who have been arrested for doing that.

Then there is also the chances of your driving off the tow truck and causing damage to either the tow truck or your vehicle...

And since some tow trucks do have parts which are attached to the vehicle which can come off during the attempt at fleeing, they can also cause personal injury to the tow truck driver or anyone else around..

It may be what you consider expensive to pay a drop fee, but balance in vehicle damages, law suits, lawyers, possible jail time all need to be looked at. But in the heat of the moment all thought goes out the window.
