Towing Issues: Small Damage but tow truck claims he doesnt touch my car when he tows, side fender, small claims court

well my car died i walked to get gas when i arrived back the place were i parked my car they had towed it.. the next day i had him tow it back i went to work when i came back i decided to look at my car and where there was a small dent in my car the metal broke and is sticking out of my car on the rear passenger side fender i called him and he told me that he doesn't touch my car in any way so he couldn't of done it.. what can i do??? i dont have any evidence that he did do it since i didn't see him tow the car but i have plenty of witnesses that can say the cut wasn't there!!

Well, given the towing methods generally used today, the vehicle is either loaded on a flatbed tow truck where the whole vehicle is dragged (For lack of better description) or it is lifted by the wheels.

Now yes there are straps and such which depending on the methods used have ratchet strap assemblies which at times are "NEAR" the wheel wells.

But it does not sound like that happened, but also a consideration is that when it was parked at the tow yard since it was impounded then vehicles are close to it... That might of been its cause...

Other than that, its more a "he says, they say" issue in any court case. Yes you have the small claims court option.
