Towing Issues: wrongful tow, inpound, small claims court

I live in Fort Worth,Tx. My truck was parked in my apartment complex last night and got towed. It wasn't double parked or in a handicapped zone. My apartment has a new policy that is to begin in September where you have to have a permit. However this is August. The rule doesn't take affect till Sept. They say that I didn't have a parking pass. Since i'm moving out at the end of August I don't need a parking pass. My apartment told me that the contract isn't in affect yet and that they had no right to tow me. It cost me $245.00 to get my car out of inpound. Since my car was completely legal how can they tow it? Isn't that illegal? I hope that I'll get at least my out of pocket expenses back, but that is not good enough. These people are crooks running a racket. They STOLE my car and made me pay for it. I did nothing wrong, shouldn't they be held liable? Why do they just drive around looking for someones day to mess up, what service are they really providing?

yeah it sounds like they just jumped the gun on the contract.

Small claims court might be the way to go, but you might also work with the apartment management. After all they are the ones who control the property and as such have the contract with the tow company... Remember that written contracts are legal binding contracts.
If they are this aggressive now, just image how it will be when they are actually "LEGAL" to tow.

And in defense of all tow companies not all of them are crooks and operate like this one does. Just a few bad apples ruin it for everyone.

As a side note, the laws in Texas regarding impounds are changing and the changes will hopefully help prevent issues like this from happening.
