Towing Issues: Towing from Grocery Store parking lot, neighborhood supermarket, tow truck driver

Richard,
   I parked my car today in my neighborhood supermarket's parking lot; walked out of the lot for a fifteen minutes, came back to shop and found that my car was towed.
   The manager of the supermarket said that he has scouts on the roof to look out for customers who leave the parking lot and that it doesnt matter when you come back or if in the end you shop at the supermarket anyway; once you leave the lot, the car will be towed.
   The issue is, I already shopped at the store and still got towed. The tow truck driver refused to give me any identification and said that he only accepts cash.  He also refused to complete the receipt and document the time he was called to tow the car, and the time he arrived to actually towed the car.  
   Finally, the rep. at the company was so rude and refused to allow me to speak to a supervisor...

WHAT DO I DO?

PS The car came back with scratches on the bumper and I was charged $216/ and supposedly the 16 was for tax.

Well I am not sure if DCA will be the right agency to complain to there, but they might be able to point you in the right direction..

As to your parking and then leaving the property, that is an issue which the property owner has had to deal with as cars in the lot, whose owners are not shopping are costing him money.. Would you shop there is there was no parking spaces available and the store was empty of customers ??
The property owners rights allow for vehicles to be towed away, and that is what is happening..

I am sorry that your experience with the tow truck driver was bad, but in defense of them, they do hear all the excuses and reasons daily as to why not do to the job they are contracted to do...

As to the poorly filled out receipt, you should get one that has all the information filled out.. But I doubt that you will get drivers full names and or supervisors full names...
Remember the privacy acts do work both directions.

Now as the the scratches on the bumper, if it can be proved that the towing company did the damage they are responsible but you most likely will have to take them to small claims court to recover any damages..

Being in Alabama, I am sorry but I am not familiar with the issue of tax being charged for towing service in New York.. Again DCA might be able to answer those questions.
