Towing Issues: tow company removed my vehicle, small claims court, apartment management

My truck was removed from my assigned parking space that I have had for two years.  They removed it at 11:45pm.  No notice given.  They charged me 281.00 to get my truck back. Is this legal in Oregon?  No apartment personel were present at the tow.  And no warning was given to me in advance.

well  as a basic answer, its hard to say if they did a legal tow without more information...

Now some apartments have towing companies that patrol lots looking for vehicles parked illegally, without permits for parking, expired tags or some other things...

Now  I bet the apartment has signs posted at the entrances which is part of the state laws.   Now warnings are not required in lots of cases.  But some places do take and give the person some notice, but that is not always the case.

The fee,  hard to really answer that as its based on a hook up fee,  mileage to the yard, extra equipment like Dollies,  storage and after hours release fees.  But it sounds inline for a tow and maybe 2 days of being in the storage yard.

Legal, well thats up to lots of factors. Like I say the sign requirements, and having the proper authorization from  authorized personell... That or several other things.
Now several cities in Oregon have made some more strict rules on impounding vehicles from Private Property, and they include, Portland, Gresham, Beaverton, Tigard, Salem, Eugene to list a few off the top of my head. (I am a former Oregonian)

Good luck, and talk to the apartment management to see what happened and what your options are.  Do not forget, you always have the Small Claims Court to use if you feel you were towed Illegally.
