Tips on Buying Cars: VOID Contract, consumer credit commissioner, office of consumer credit commissioner

Question
purchased a vehicle 06/28/08, I am on my third set of temporary tags. Per the dealership they will not Regis?
the vehicle due to i have not finish paying on the down payment of $1400.00. So per the fiance company they are wanting me to make payments on an vehicle that I do not own per dmv due to the vehicle is not registered. Also per the dealership they want to void the contract and me bring the vehicle back, but they have sold my trade in and only wants to give me $200 for the trade. But on my finance paperwork they put that the GROSS TRADE -IN $5000.00. I refuse to make payments on an vehicle that I do not own. Then when I went to the dealership on 08/28/08 to pickup my third set of temp tags the lot was empty. Per the dealership they are under construction. What are my options? Because per the finance company they are planning on repossession the vehicle due to I refuse to make payments.

Answer
Latina,

Thanks for your question.  First, you do own the vehicle.  You own the vehicle per your contract with the bank.  You need to make those payments.  You need to make them fast.  You are ruining your credit and it will get even worse if they repoesses the vehicle.  Do you have a legal claim against the dealership, yes probably, but the legal system takes forever and it will never repair your credit.  You need to call the local DMV in your state and talk to them and find out your options.  Tell them that you are on your third red tag.  If you are in the state of Texas you can call the office of consumer credit commissioner and file a complaint on the dealership, and most other states have something very similar to that.  I don't know what state you are in, but in the state of Texas it is against the law for the dealership to give you more than one red tag.  I believe it is that way in most other states.  I would have to know exactly what state you are in and I could let you know that.

First and foremost the only thing you need to be concerned about right now is making the payments.  Make the payments and do not let that vehicle repo.

Hope this helps.

Thanks - Jb
