Tires: Double nail tire penetratrion, passenger car tire, legal ramifications

I just read the question from the firefighter concerning a double nail penetration and the Firestone Dealer refusing to repair it.  I had the same thing happen to me yesterday and the Discount Tire Rep told me it was illegal for them to repair the tire and that it should be scraped.  The tire had plenty of tread left and a new one was quoted at $160.  Was he just blowing smoke or is it truly illegal in Texas?

As far as I know, there are no laws regarding the repair of tires.  But then again I am not an attorney, and there might be some local or state regulations.  For example, there might be a regulation about what kinds of tires can be fitted to the front of a bus - and that might not include tires with repairs.

BUT

There are guidelines for repairing tires and certain size of damage and the location of the damage would render a passenger car tire unrepairable according to these guidelines.

AND

Failure to follow these guidelines might be considered negligent behavior and have legal ramifications - and that might be worded loosely as being "illegal".
