Used Cars: minor buying an automobile, refund clause, sunroof

Question
My friend who lives in Md. took his granddaughter to Va. to buy a car.  She gave them a downpayment, because the car needed some work done on it.  Turns out the sunroof cannot be fixed.  They gave her a receipt that says no refunds.  She is 16 years old.  Can she cancel this deal and get her money back?  She is the only one who signed anything.  Thanks in advance for any help you can give me.

Answer
Well this really depends on the paperwork and the dealership... if it says "a non-refundable down payment" or something similar in the paperwork... well legally there is nothing she can do... but if it doesn't she can get that down payment back.  Sometimes even if the paperwork has a no-refund clause a larger nice dealer will give the money back (never hurts to ask right?).  Read over anything signed, just a no-refund on the receipt isn't enough if it isn't in writing somewhere else.  If you find out it is in writing, and they wont be nice and give it back... either bargain for them to replace the sunroof, take the hit and walk away, or buy the car and fix the sunroof at a later date yourself (or replace it.. since it cant be fixed).  So look over anything signed, see if she agreed to pay a non-refundable down payment... and hope she didn't.... then you will either have to take them to court or just show them the agreement and they should give in.  Otherwise if she did agree... ask if they will refund anyway... or buy the car and have them pay to replace the sunroof, dont buy the car and lose the money, or buy the car and replace the sunroof out of your own pocket.  Sorry there isn't more you/she can do.. this is why you always read over anything you sign, and don't put down payments on cars that "need some work"... for future reference.. Good luck and I hope you find something good news in that paperwork.
